General Terms
Arivia Sim is on a mission to provide seamless global data connectivity for all travellers. We provide our Platform and Services under the entity Arivia Sim, a company registered in Belgium at Ferdinand Verstraetenlaan 32/2, 1910 Kampenhout. We operate as an aggregator and marketplace of connectivity services. In other words: we identify the best providers of data connectivity services for every country or region, and make their services available to our customers via the Arivia Sim platform. This is how we are able to provide eSIMs to keep you connected wherever your travels take you.
Before using our Services (eSIMs and associated support services provided by us) or Platform (our website ariviasim.be and any pages managed by Arivia Sim on social media platforms), we ask that you read the terms applicable to your use, and the policies that apply. These include:

- The "Terms of Use of our Services" will apply where you are a user of our Services.
- Where you access our Services through a third party (such as an employer or partner of Arivia Sim), the Terms of Use still apply but should be read alongside your agreement with that third party. We cannot take responsibility for the actions of, or your agreement with, any third party.
- Our Privacy Policy will apply in all instances where we collect your personal information.

Your use of our Services and Platform is conditional on your acceptance of our Terms. If you don't accept or cannot comply with these Terms, you must not access or use our Services or Platform. You agree to these Terms by using our Platform or Services, browsing or clicking on any content, signing up, or using our app.
From time to time we may update our Terms. We will do our best to notify you if the changes are material. Any change will become effective as of its date of publication. If you no longer wish to accept our Terms, you should stop using our Services or Platform after the updated Terms are published.

To the extent that our Services or Platform include links to — or are hosted on — a third-party website or social media platform (for example, our payment service providers, Instagram, or Facebook), and there are separate terms of use relating to that platform, you agree to comply with those in addition to these Terms.
Sharing Information with Arivia Sim
Your privacy is important to us. Personal data we collect about you while you use our Services or Platform will be handled in accordance with our Privacy Policy.
Intellectual Property Rights
All intellectual property rights in our Platform and Services are owned by or licensed to Arivia Sim. This includes copyright (including in our software), trade marks, know-how, trade secrets, and the design, compilation, and look and feel of our Platform (together, the "Intellectual Property Rights"). In using our Platform and Services, you agree to do so only for their intended purpose and in accordance with these Terms.
We value your feedback. Where you provide us with feedback, we may incorporate it into our Services or Platform. You confirm that no intellectual property right arises in relation to such feedback, and no compensation shall be due to you.
Disclaimer of Liability
EXCEPT WHERE RESTRICTED BY LAW, IN NO EVENT WILL WE BE RESPONSIBLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR SERVICES AND PLATFORM ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. IN PARTICULAR, WE DO NOT GUARANTEE THAT THEY WILL BE AVAILABLE AT ALL TIMES, NOR THE QUALITY OF THE UNDERLYING CONNECTIONS AND NETWORKS. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL IMPLIED CONDITIONS, WARRANTIES, REPRESENTATIONS OR OTHER TERMS THAT MAY APPLY TO THE PROVISION OF OUR SERVICES AND PLATFORM.
TO THE EXTENT PERMITTED BY LAW, YOU WILL INDEMNIFY ARIVIA SIM AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND CONTRACTORS FOR ANY THIRD-PARTY LEGAL PROCEEDINGS ARISING OUT OF OR RELATING TO YOUR UNLAWFUL USE OF OUR SERVICES OR VIOLATION OF THESE TERMS.
Governing Law and Courts
Irrespective of the country from which you access our Services or Platform, these Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Belgium. The competent courts of Belgium shall have exclusive jurisdiction.
Class Action Waiver
You agree that you waive the right to participate as a plaintiff or class member in any class action proceeding. Any proceedings to resolve disputes must be conducted on an individual basis, and not in a class, consolidated, or representative action.
Enforcement of Terms
If any part of these Terms is found to be legally unenforceable, that part will be disregarded to the extent it is unenforceable, but everything else will remain in full force and effect.
